These Terms and Conditions constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Fecn Technologies Ltd. ("Shopinn," "we," "us," or "our"), concerning your access to and use of the Shopinn website, mobile apps, and related services (together, the "Platform").
By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Platform.
Shopinn is an online marketplace based in Nairobi, Kenya. Products on the Platform are listed and sold by independent third-party stores ("Sellers"). Shopinn provides the storefront, secure checkout, and the logistics network used to deliver orders.
By creating an account or placing an order, you represent and warrant that:
We may verify your email address before your account is fully active, and may suspend or close accounts that breach these Terms.
We and our Sellers make every effort to display products and their details — including colours, features, specifications, and prices — as accurately as possible. However, we do not warrant that product descriptions or other content is always accurate, complete, or error-free.
All prices are shown in Kenyan Shillings (KES) and include applicable taxes unless stated otherwise. Delivery fees are calculated and shown at checkout before you pay. If a pricing or product error is discovered after you order, we may cancel the affected order and refund any amount paid.
Placing an order is an offer to buy. Your order is accepted once we confirm it; we may decline or cancel an order (for example, where an item is out of stock, a pricing error occurred, or payment could not be verified).
We accept M-Pesa, Visa, and Mastercard, processed through our payment partners. You agree to provide current, complete, and accurate payment information, and you authorise us (and our payment partners) to charge the total order amount, including delivery fees, to your chosen payment method.
Orders are delivered across Kenya by Shopinn's logistics network or made available for collection at a pickup station. On delivery, you confirm receipt using a one-time code shared with the rider, or presented at the pickup station, to verify your order is handed to the right person.
Estimated delivery timelines and fees are shown at checkout and explained on our Shipping & Delivery page. Timelines are estimates and may vary during peak periods or due to circumstances beyond our control.
You may cancel an order at any time before it is dispatched. To cancel, go to your Orders page or contact our support team promptly. Once an order has been dispatched it cannot be cancelled, but eligible items may be returned in line with the policy below.
We accept returns within 7 days of delivery. To be eligible for a return:
Certain items are non-returnable for health, safety, or hygiene reasons, including perishable goods, custom or made-to-order products, and personal care items — unless the item arrived damaged, defective, or not as described.
Once your return is received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds are returned to your original payment method (for example, an M-Pesa reversal or a reversal to your card), typically within 5–10 business days, depending on your provider.
Sellers are responsible for the products they list and must comply with Shopinn's seller policies and applicable law. Shopinn moderates listings but is not the manufacturer of Seller products.
You agree not to use the Platform for any unlawful purpose, to interfere with its operation, to attempt unauthorised access, or to post false, misleading, infringing, or abusive content. We may remove content and suspend access for breaches of these Terms.
The Platform and its content — including source code, software, design, text, graphics, logos, and trademarks (the "Marks") — are owned by or licensed to Shopinn and are protected by applicable laws. Seller-supplied content (such as product images and descriptions) remains the property of, or is licensed by, the relevant Seller. You may not copy, reproduce, or exploit any part of the Platform without our prior written permission.
To the maximum extent permitted by law, Shopinn and its directors, employees, and agents will not be liable for any indirect, consequential, incidental, special, or punitive damages arising from your use of the Platform or from any goods purchased through it. Nothing in these Terms limits any rights you have under the Consumer Protection Act and other mandatory laws of Kenya.
These Terms are governed by the laws of Kenya, and any disputes are subject to the jurisdiction of the Kenyan courts.
We may update these Terms from time to time. The latest version is always available on this page, and the "Last updated" date above reflects the most recent changes. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
